Chapter 6, APPEARANCE TICKETS

§ 6-1. Purpose.

The Board of Trustees of the Village of Honeoye Falls, pursuant to the authority granted to it by § 10, Subdivision 4, of the Municipal Home Rule Law and § 150.50 of the Criminal Procedure Law, desires to authorize certain public servants to issue appearance tickets in aid of the enforcement of any statute, local law, ordinance, rule and regulation of the Village of Honeoye Falls.

§ 6-2. Authority to issue tickets.

  1. The Village Clerk is hereby designated the public servant authorized by law to issue appearance tickets in the performance of his/her respective duties when commencing prosecutions for alleged violations of any statute, local law, ordinance, rule or regulation of the Village of Honeoye Falls, New York.
  2. This authority is granted pursuant to § 150.50 of the Criminal Procedure Law of the State of New York. The term "appearance ticket" as used in this section shall have the same meaning as provided in § 150.50, and the procedure governing the use of appearance tickets shall conform in all respects to the procedures set forth in Article 150 of the Criminal Procedure Law and other applicable articles of that law.

§ 6-3. Powers of Clerk.

Such authorization to use the appearance tickets shall not imply any restraint upon the power of the Village Clerk to utilize other methods of commencing prosecutions for alleged violations of any statute, local law, ordinance, rule or regulation of said village as may be provided by law.

§ 6-4. Construal of provisions.

The foregoing authorization is in addition to any and all authorizations heretofore or hereafter given. Any inconsistencies shall be construed in favor of liberal and additional authorization to issue appearance tickets.
